Burial of the Confederate Dead at Antietam (December 25th, 1867)

Summary: Gov. Fenton of New York has written to John Jay, Esq., Special Commissioner from New York to the Antietam Cemetery Board, about the burial of Rebels who died during that battle. There has been an on-going controversy about whether to bury Confederates in the Cemetery. Some people local to the area have been violently opposed. An 1865 supplement to a Maryland bill provided for the burial of Confederates, but it seems that some of the legislators as well as some people on the cemetery board may have been unaware of the bill. Attitudes have changed in the intervening years. Gov. Fenton recommends that a portion of the ground be put aside for Confederate burial and the Baltimore American agrees. Over five years after the battle, bones are still lying in the open across the area. [from Baltimore American]
